China is a signatory to The Hague Adoption Convention.
We are currently only accepting applications of BC residents hoping to complete a adoption of a relative child from China.
Sunrise facilitates relative adoptions from China. The Central Authority in China is known as the China Centre for Children’s Welfare and Adoption (CCCWA). The laws of China require all adoptive parents applying to adopt children to whom they are related, follow the laws in their country of residence and the laws of China. Adoptive parents who reside in Canada must engage a licensed adoption agency and complete a homestudy in their home province. Completing an adoption in China without going through the proper process will result in Immigration, Refugees and Citizenship Canada (IRCC) denying your adopted child’s immigration application to move to and reside in Canada permanently.
CCCWA allows relative adoptions of children under the age of 18 years. The China Adoption Act only allows relative adoption up to third degree of kinship and where the child belongs to a collateral relative by blood of the same generation.
For a relative adoption to be approved, the child to be adopted must be a child in need of adoption, meaning the child’s needs are not being provided for by the biological family in China. A child’s needs refer to the child’s health, safety, shelter, education and/or financial needs. It must be shown that the adoption arrangement, and the child being brought to Canada is in the best interests of the child.
Relative adoptions require the consent of the biological parents.
